The court found that while the Respondent had a valid reason to terminate the Claimant’s employment due to his failure to account for Ksh 40,112.00 out of Ksh 60,112.00 collected from a client, the disciplinary process was procedurally flawed. The Claimant was denied the opportunity to be represented by a union official, to call witnesses, to cross-examine accusers, and was not provided with the investigation report. These procedural lapses contravened Section 41 of the Employment Act and established case law. As a result, the termination was declared unlawful on procedural grounds, and the Claimant was awarded compensation equivalent to three months’ gross salary.
