The court found that the Respondent failed to comply with the mandatory redundancy procedures under Section 40(1) of the Employment Act, specifically the requirement to notify the employee and the labour officer at least one month prior to the intended redundancy. There was no evidence of such notification or of any meetings with the labour officer. The Respondent also failed to provide criteria for selecting the Claimant for redundancy. As a result, the termination was unlawful and unfair under Section 45 of the Employment Act. The court further found that the Claimant had been paid certain terminal dues, including notice pay, severance, and leave, and therefore declined those claims....
