Ratio Decidendi

The court found that the Claimant's claim for salary arrears was a continuing injury, as the arrears began accruing in February 2012 and continued to accumulate until February 2022. The suit was filed on 22nd August 2022, within six months of the last adjustment of the claimed amount. Applying section 90 (now section 89) of the Employment Act and relevant case law, the court held that the limitation period for continuing injury claims is twelve months from the cessation of the injury. Since the suit was filed within this period, it is not time-barred. The Respondent's preliminary objection, based on limitation of actions, was therefore dismissed as unmerited.
