Furthermore, the court held that the application was incompetent because the appeal itself was filed out of time without leave of court, contrary to Section 79G of the Civil Procedure Act. Since the appeal was not validly before the court, the application for stay of execution could not be entertained. The court therefore dismissed the application and directed the appellant to show cause why the appeal should not be struck out for being filed out of time without leave.
