Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial court erred in applying a dependency ratio of 1/3 instead of 2/3 for the deceased who was married with three children.
  2. 2 Whether the evidence adduced sufficiently proved the existence of dependents for the purpose of calculating damages.

Ratio Decidendi

The court found that the evidence, including the chief's letter listing the wife and three children as dependents, was sufficient to prove dependency on a balance of probabilities, even in the absence of marriage and birth certificates. The court held that, given the deceased's status as an African man with a wife and three children, it was reasonable to expect that he supported them financially. Therefore, the trial court erred in applying a dependency ratio of 1/3, and the correct ratio should be 2/3. The appeal was allowed, the dependency ratio was set aside and substituted with 2/3, and costs of the appeal were awarded to the appellants.

Court Disposition

Appeal allowed. Dependency ratio of 1/3 set aside and substituted with 2/3. Costs of the appeal to the appellants.

Orders

  • The dependency ratio of 1/3 adopted by the trial court is set aside and substituted with a dependency ratio of 2/3.
