The court found that the applicant failed to establish a prima facie case with a probability of success as required for the grant of a temporary injunction. The sale agreement between the applicant and the 2nd respondent did not receive the mandatory Land Control Board consent, rendering it void under the Land Control Act. The 2nd respondent lawfully sold the land to the 1st respondent, who paid the full purchase price and took possession. The applicant was not in possession of the suit land at the time of the application, having lost it to the 1st respondent. Consequently, the application for a temporary injunction was dismissed for lack of merit.
