Procedural Posture

  1. 1 Whether the 1st and 3rd Defendants have established grounds for stay of proceedings against them.
  2. 2 Whether the suit against the 1st and 3rd Defendants should be struck out.
  3. 3 Who should bear the costs of the application.

Ratio Decidendi

The court found that Kisumu ELC No.58 of 2012, which the Defendants relied upon to seek a stay, had already been withdrawn and was therefore not pending. The Plaintiff, Grace Ayugi Mahulo, was properly appointed as administratrix of the deceased's estate and was entitled to bring the present suit. The court held that there was no merit in the application for stay or striking out of the suit against the 1st and 3rd Defendants. Consequently, the notice of motion dated 17th August 2015 was dismissed with costs to the Plaintiff.

Court Disposition

Application dismissed with costs to the Plaintiff.
