The court found that the applicants had promptly filed a notice of appeal and applied for proceedings immediately after the High Court judgment. The delay in filing the memorandum and record of appeal was attributed to the late availability of typed proceedings, which was beyond the applicants' control. Upon receipt of the proceedings, the applicants acted without undue delay by filing the present application. The court was satisfied that the intended appeal was not frivolous, as evidenced by the draft memorandum of appeal. In the absence of opposition from the respondents and considering the interests of justice, the court exercised its discretion to grant the extension of time sought.
