Ratio Decidendi

The court found that although the objectors initially alleged the existence of a written will, they failed to prosecute their application to prove the will and ultimately abandoned the claim. The court therefore deemed the deceased to have died intestate. The mode of distribution proposed by the petitioners was found to be reasonable, as it included all beneficiaries, regardless of gender, and was consented to by all except the objectors. The court ordered that the estate be distributed as per the petitioners' proposal, rejecting the objectors' claim that only sons should inherit based on the unproven will.
