Ratio Decidendi

The court found that the Plaintiff is entitled to 0.525 hectares of land parcel KERICHO/KABIANGA/932 as per the rectified Certificate of Confirmation of Grant issued in Kericho HC Succession Cause No. 109 of 2009. The Defendants failed to provide any evidence that the grant had been revoked or annulled, nor did they justify the continued lodging of the caution. The court held that the Defendants' actions in maintaining the caution were without legal basis and served only to deny the Plaintiff her rightful share as determined by the succession proceedings. Therefore, the caution must be removed to allow the Plaintiff to obtain her title in accordance with the confirmed grant.
