Procedural Posture

Originating Summons / Ruling on Interlocutory Application for Injunction and Transfer

  1. 1 Whether the applicants have established a prima facie case to warrant the grant of an interlocutory injunction.
  2. 2 Whether the applicants are entitled to injunctive relief over land parcel Githunguri/Kimathi/847.
  3. 3 Whether the suit should be transferred to the Principal Magistrate’s Court at Githunguri for hearing and determination.

Ratio Decidendi

The court found that the applicants did not purchase the entire parcel Githunguri/Kimathi/847 but only a portion to be excised from it. Court Disposition

Application for injunction dismissed; application for transfer of suit allowed.
