Procedural Posture

Notice of Motion / Application to Set Aside Dismissal for Want of Prosecution

  1. 1 Whether the claimant was properly served with the notice to show cause for dismissal for want of prosecution.
  2. 2 Whether the dismissal order should be set aside and the suit reinstated on its merits.

Ratio Decidendi

The court found that the notice to show cause was properly addressed and served to the claimant at the address she provided in her memorandum of claim. The claimant did not deny receipt of the notice. The ground advanced by the claimant, that her former advocates were served and failed to inform her, was found to be misleading. There was no mistake on the part of the claimant's former advocates. Consequently, the application to set aside the dismissal order and reinstate the suit lacked merit and was dismissed with costs.
