The Court of Appeal found that the applicant had demonstrated the existence of an arguable appeal, particularly on the issues of the date of commencement of adverse possession and whether the applicant's occupation was interrupted by a suit to which she was not a party. The Court further held that the appeal could be rendered nugatory if the applicant were evicted or the property alienated before the appeal was heard, as this would destroy the subject matter of the appeal. Accordingly, the Court exercised its discretion under Rule 5(2)(b) to grant a stay of execution and injunctions to preserve the status quo pending the determination of the appeal, finding that the interests of justice...
