The misdescription in the notification of sale did not negate the Defendant's statutory right of sale, especially as the Plaintiff had not demonstrated oppression or lack of basis for the exercise of that right. The Plaintiff failed to discharge the burden required for the grant of an interlocutory injunction as set out in Giella v. Cassman Brown. Accordingly, the application for injunction was dismissed with costs.
