Ratio Decidendi

The court held that it would have been prudent for the trial court to allow the applicant to respond to the application before issuing such orders. In the interest of justice, and given that the applicant had complied with the original stay conditions, the court granted a stay of execution of the ex-parte orders pending the hearing and determination of the appeal.
