Procedural Posture

Notice of Motion / Ruling on Contempt Application and Preliminary Objections

  1. 1 Whether the respondents/contemnors had knowledge of and willfully disobeyed the court orders issued on 29th October 2015.
  2. 2 Whether the orders were properly served or brought to the attention of the alleged contemnors.
  3. 3 Whether the application for contempt was merited given the status of the suit property and the parties involved.

Ratio Decidendi

The court found that the applicant failed to prove that the respondents had knowledge of or were served with the court orders of 29th October 2015, as required for a finding of contempt. The evidence did not establish that the alleged contemnors were present at the site or parties to the proceedings when the orders were issued. Furthermore, the suit property had been attached, subdivided, and sold in separate anti-corruption proceedings, and the applicant had lost proprietary and constitutional rights over it. The application for contempt was therefore devoid of merit, constituted an abuse of court process, and was made in bad faith. The court dismissed the application and awarded costs...
