Miscellaneous Application / Ruling on Application for Consolidation, Judgment on Taxed Costs, and Interest

  1. 1 Whether the suits should be consolidated for purposes of the application.
  2. 2 Whether judgment should be entered in terms of the certificates of taxation issued in the various files.
  3. 3 Whether the applicant is entitled to charge interest at 9% on the taxed costs from 30 days after service of the bills.

Ratio Decidendi

The court found that all the matters involved the same parties and were similar in nature, justifying consolidation for the purpose of the application. The court held that, pursuant to section 51(2) of the Advocates Act, judgment could be entered in terms of the certificates of taxation issued in each file. Regarding interest, the court applied paragraph 7 of the Advocates Remuneration Order, allowing the applicant to charge interest at 9% per annum from 30 days after service of the bills (15th May 2002) until payment in full, but only for those bills that remained unpaid at the time of filing the application. No interest was allowed on bills paid before the application was filed.

Court Disposition

Application allowed in part.
