Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appeal is competent in the absence of the decree appealed against.
  2. 2 Whether failure to include the decree in the record of appeal is a fatal omission warranting striking out of the appeal.

Ratio Decidendi

The court held that the inclusion of the decree appealed from in the record of appeal is a mandatory requirement under Order 42 Rule 13(4)(f) of the Civil Procedure Rules. The omission of the decree is a fatal procedural defect that renders the appeal incompetent. Since jurisdiction is fundamental, the court cannot proceed to consider the merits of an appeal that is incompetent for want of a primary document. Consequently, the appeal was struck out with costs for non-inclusion of the decree.

Court Disposition

appeal struck out as incompetent for non-inclusion of the decree

Orders

  • The appeal is struck out with costs to the respondents for non-inclusion of the decree.
