Criminal Revision / Ruling on Application for Sentence Revision
Legal Issues
- 1 Whether the sentence imposed on the applicant should be revised.
- 2 Whether the applicant is suitable for a non-custodial sentence.
Ratio Decidendi
The court declined to revise the sentence imposed on the applicant after considering the presentence report, which indicated that the applicant belonged to a larger criminal gang and that the community was hostile towards him. The court found that the applicant was not suitable for a non-custodial sentence until he demonstrated reformation. The original sentence of two years' imprisonment for entering a dwelling house with intent to steal was therefore upheld, as the circumstances did not warrant interference with the sentence imposed by the trial court.
Court Disposition
Application for sentence revision declined.
Orders
- Sentence imposed by the trial court is upheld.
- File closed.
