The High Court found that the trial magistrate erred in apportioning 100% liability to the Appellant without properly evaluating the credibility and weight of the evidence, particularly the police abstract and witness testimonies. The court held that the 2nd Respondent bore greater responsibility for the accident, but the Appellant also contributed by overlapping at a junction. Liability was apportioned at 80% to the 2nd Respondent and 20% to the Appellant.
