The High Court held that the Kadhi Court, as established under Article 170(5) of the Constitution and Section 5 of the Kadhi Courts Act, does not have jurisdiction to determine matters relating to the custody and maintenance of children. The court reasoned that neither the Constitution nor the Kadhi Courts Act expressly grants such jurisdiction, and the omission is deliberate, given that the Children Act provides a comprehensive legal framework for all children matters in Kenya. Only judicial officers gazetted under the Children Act have authority to adjudicate such issues.
