Ratio Decidendi

The court held that it was not functus officio as the orders sought were incidental to the execution of its judgment and did not require a merit-based re-engagement with the case. The court found that the applicant had made reasonable efforts to implement the judgment but was impeded by the respondents' lack of cooperation. Since a final decree in the form of a confirmed grant had not been issued, the court retained supplementary jurisdiction to facilitate execution. The court concluded that it, and not the Kadhi's Court, had jurisdiction to entertain the application and issue the necessary orders to perfect its judgment.
