Procedural Posture

Miscellaneous Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant is entitled to stay of execution of the decree pending appeal.
  2. 2 Whether the application for stay was made without unreasonable delay.
  3. 3 Whether the applicant has demonstrated substantial loss may result if stay is not granted.

Ratio Decidendi

The court found that although there was a delay between the applicant receiving the proceedings and filing the application, the main ground of appeal—lack of proof of the actual defamatory words—was arguable. The court held that the appeal would be rendered nugatory if stay was not granted, as there was no evidence the respondent could refund the decretal sum if the appeal succeeded. However, the unexplained delay warranted that the applicant bear the costs. The court exercised its discretion to grant stay of execution on the condition that the applicant deposits Ksh. 200,000 into a joint interest-earning account within 30 days, failing which the stay would lapse.

Court Disposition

Application for stay of execution pending appeal granted on condition.

Orders

  • Prayer number 3 of the application dated 2nd August, 2017 is granted on condition that the applicant deposits Ksh. 200,000 into an interest earning account to be opened by his advocate and the advocate for the respondent within 30 days; otherwise, the orders shall stand vacated.
  • Applicant to bear the costs of the application to the respondent.
