Ratio Decidendi

The court found that the appellant filed the memorandum and record of appeal out of time and without leave of court, making the appeal incompetent. The subsequent application for leave to appeal out of time, filed only after service of the motion to strike out, could not cure the defect. Consequently, the appeal was struck out. With the appeal struck out, there was no legal basis to retain the decretal sum deposited as security, and the balance of the decretal sum was ordered to be released to the 1st respondent's advocate. The court allowed the motion as prayed, including costs to the applicant.
