Ratio Decidendi

The court found that the order closing the file was made in error because the Court of Appeal ruling only struck out the plaintiff's suit and did not address or strike out the defendant's counterclaim. The counterclaim, being an independent suit, remains pending before the court and should be determined on its merits. The court therefore reviewed and set aside the closure order, allowing the 5th defendant's preliminary objection to the counterclaim to be set down for hearing. Costs of the application are to abide the outcome of the preliminary objection.
