Procedural Posture

Civil Appeal / Ruling on Application to Lift Stay Orders and for Security

  1. 1 Whether the appellants satisfied the conditions for grant of stay of execution pending appeal.
  2. 2 Whether the appellants offered security as required by law for stay of execution.
  3. 3 Whether there was unreasonable delay in filing the application for stay.

Ratio Decidendi

The court found that while the appellants filed their application for stay within a reasonable time, they failed to offer or demonstrate willingness to provide security as required by law. The court further held that the appellants had already consented to the sale of the properties and had not appealed the decision regarding their right to purchase. The proceeds of sale were deposited in court, and the appellants' share remained available for collection. The court was not persuaded that the appellants would suffer substantial loss or that the stay was merited. Consequently, the application for stay was disallowed, and the temporary stay orders were lifted.

Court Disposition

Application for stay disallowed; temporary stay orders lifted; each party to bear own costs.

Orders

  • The orders of temporary stay granted on 5th July, 2012 are lifted in terms of prayer (2) of the Notice of Motion dated 26th July, 2012.
