Ratio Decidendi

The court found that the impugned documents were not produced in the lower court and that Order 42 Rule 27(4) of the Civil Procedure Rules, 2010 expressly prohibits the introduction of additional evidence at the appellate stage without leave of the court. The appellant did not seek or obtain such leave before compiling the record of appeal. Allowing the documents would be unfair and prejudicial to the respondent, as it would amount to amending the appeal and introducing new evidence without due process. The court therefore allowed the application to expunge the documents and awarded costs to the respondent.
