The court accepted the explanation that the delay was due to unavoidable family circumstances affecting the deponent, an expert in refugee affairs. Given the importance of the expert evidence to the substantive issues affecting a large refugee population, and the absence of any demonstrated prejudice to the respondents, the court exercised its discretion to allow the application.
