Procedural Posture

Civil Case / Judgment

  1. 1 Whether the respondent advocate is obligated to refund the balance of client funds held in trust after the conclusion of the underlying litigation.
  2. 2 Whether the applicant has discharged the burden of proof to warrant judgment in her favour for the claimed sum.

Ratio Decidendi

The court found that the applicant had proved, through documentary evidence and unopposed testimony, that she deposited Kshs.2,000,000 into the respondent's client account to be held in trust. The respondent had refunded only part of this sum and failed to demonstrate any legal entitlement to retain the balance. The court held that, in the absence of a lien or other justification, the respondent was obligated to refund the remaining client funds. The applicant discharged her burden of proof, and the respondent, having failed to contest the claim, was ordered to pay the outstanding amount with interest from the date of demand until payment in full.
