The court found that the application for contempt against the OCPD and OCS Wajir was premature and incompetent because the applicant had not obtained a warrant of eviction nor appointed a court bailiff or auctioneer to execute the eviction order. There was no evidence that any such officer sought security from the OCPD and OCS and was denied. The role of the OCPD and OCS was limited to providing security upon request by the executing officer, not to carry out the eviction themselves. Without the necessary procedural steps being taken by the applicant, the court could not find the officers in contempt. The application was therefore dismissed as incompetent.
