Ratio Decidendi

The court found that the Claimant was constructively dismissed in December 2008 when her salary ceased and she was forced to leave her post in Uganda. Under Section 90 of the Employment Act, the limitation period for filing employment claims is three years from the date of dismissal. The Claimant filed her suits on 29th July 2013, which was more than one and a half years after the limitation period expired in December 2011. Consequently, the court held that the suits were time-barred and dismissed them without considering the substantive merits or the question of territorial jurisdiction. Each party was ordered to bear its own costs.
