The Court of Appeal held that as at June 30, 1981, the Senior Deputy Registrar had no jurisdiction to hear and determine an application for security for costs under Order XXV rule 1 of the Civil Procedure Rules. Section 3A of the Civil Procedure Act did not empower a High Court judge to delegate the hearing or determination of such an application to the Registrar or any other officer. The purported delegation of the judicial function was fatally irregular and rendered the proceedings and decision a nullity.
