The court found that the applicant failed to prove adverse possession over the entirety of MN/III/1111 and MN/III/1112, as he was not in possession of the whole of the suit properties. The evidence established that the applicant, and previously his late father, had occupied only a portion of MN/III/1112. The court held that adverse possession could only be established to the extent of the applicant's actual occupation. The period for adverse possession began when the property was registered in the name of the 1st respondent in 1989, but was interrupted by the filing of HCCC 732 of 1991.
