Ratio Decidendi

The court found that although the claimant had previously filed a suit (Mombasa CMEL E130 of 2020) against the respondent over the same subject matter, that suit was withdrawn on 31st July 2023 before the present claim was filed on 1st August 2023. The withdrawal of the earlier suit brought those proceedings to an end, and there was no pending suit between the parties at the time of filing the current claim. The sub judice rule under Section 6 of the Civil Procedure Act only applies where there is a previously instituted suit pending between the same parties over the same subject matter. Since the earlier suit had been withdrawn and ceased to exist, the present claim is not sub judice....
