Ratio Decidendi

The Court found that the applicants had demonstrated an arguable appeal on the question of whether the respondent held the suit property in trust for himself and his siblings. The Court further held that if the stay was not granted, the 1st applicant, who is in occupation and whose husband is buried on the land, would be evicted, rendering any successful appeal nugatory. Satisfied that both limbs for the grant of stay under Rule 5(2)(b) were met, the Court allowed the application for stay of execution pending the lodgment and determination of the intended appeal.
