The court held that bail pending appeal is not a constitutional right but a discretionary remedy granted only in exceptional or unusual circumstances. The applicant's good character and lack of previous convictions do not, by themselves, constitute exceptional circumstances. However, upon reviewing the trial proceedings, the court found that the applicant's appeal is likely to succeed as regards the sentence, which constitutes sufficient ground to grant bail pending appeal. The court therefore admitted the applicant to bond or cash bail pending the determination of the appeal.
