Procedural Posture

Constitutional Petition / Ruling on Interlocutory Applications and Preliminary Objection

  1. 1 Whether the Petitioners have locus standi to institute proceedings regarding the suit land as members and officials of Africa Inland Church (AIC) Muisuni.
  2. 2 Whether the dispute over ownership and use of Kangundo/Muisuni/945 and 1009 is subject to the internal dispute resolution mechanisms of the church.
  3. 3 Whether the Petitioners have established a prima facie case for grant of conservatory orders restraining the Respondents from interfering with the suit land.

Ratio Decidendi

The Petitioners, as members and officials of Africa Inland Church (AIC) Muisuni, were recognized as beneficiaries of the property and thus had locus standi to challenge any alleged illegal dealings by the Respondents, even if the Respondents were trustees. The official searches indicated the land was reserved for AIC Muisuni and not registered in the name of the Africa Inland Church Kenya Trustees...

Court Disposition

  • The Respondents to pay costs of the Application.
