The fact that the original grant may have been obtained fraudulently does not preclude a legitimate claim to the estate. As for the criminal proceedings, the court held it lacked jurisdiction to stay them because they are distinct from the succession cause, and the Director of Public Prosecutions, who initiated the criminal case, was not a party to the application and had not been heard.
