Ratio Decidendi

The court found that the suit was not brought under the principle of subrogation, as the plaintiff did not plead that he had been compensated by his insurer or that the claim was for the insurer's benefit. Therefore, the plaintiff could not avoid an award of costs on that basis. Even if the claim had been under subrogation, the plaintiff would still be liable for costs, with recourse to the insurer for reimbursement. The court exercised its discretion under Section 27(1) of the Civil Procedure Act, guided by the general rule that costs follow the event. There was no reason to depart from this principle, as the defendant was the successful party upon dismissal for want of prosecution....
