The High Court held that its jurisdiction on appeal from the Small Claims Court is confined to matters of law only, not fact, as per Section 38(1) of the Small Claims Court Act. Most grounds of appeal improperly invited the court to re-evaluate factual findings, which is impermissible. Only the ground concerning the legal entitlement to interest was considered. The court found that, although there was no express agreement on interest, a formal demand for payment was made on 29th May 2023, and the respondent failed to pay.
