The 1993 letter of offer, which was the basis of the defendant's position, was never executed, and there was no evidence of a valid charge after 1993. The 1985 charge had been satisfied, and any claim based on it was time-barred under the Limitation Act. The absence of a valid contract or charge meant the defendant could not lawfully sell the plaintiff's property. As the defendant failed to controvert the plaintiff's contentions, the court granted the application to strike out the defence and enter interlocutory judgment for the plaintiff.
