Ratio Decidendi

The court found that although the applicant failed to explain the one-month delay in filing the appeal to its satisfaction, the delay was not inordinate. Recognizing the equitable nature of the remedy and the court's inherent powers under Section 3A of the Civil Procedure Act, the judge determined that it would be in the interest of justice to allow the applicant to ventilate his intended appeal. The court thus exercised its discretion to extend the time for filing the appeal and granted a conditional stay of execution, requiring the applicant to deposit the decretal sum and costs in a joint interest-earning account within 30 days.
