The plaintiff/applicant admitted to instructing withdrawal of the suit and did not demonstrate any mistake, fraud, or collusion by his advocate. The law does not provide for reinstatement of a withdrawn suit; the only available remedy is to file a fresh suit. The application for reinstatement was therefore found to be an abuse of the court process.
