Ratio Decidendi

The court found that the applicant had satisfied the requirements for grant of stay of execution pending appeal. The decretal amount was substantial and could occasion substantial loss to the applicant if paid out before the appeal is determined. The application was filed without unreasonable delay, and the applicant had offered to provide security. Accordingly, the court exercised its discretion to grant a conditional stay of execution, requiring the applicant to deposit half the decretal sum in a joint interest earning account in the names of the advocates for the applicant and the 1st respondent.
