The High Court held that the trial court lacked jurisdiction to determine the succession cause as the value of the estate was Kshs. 300,000, exceeding the statutory limit of Kshs. 100,000 for magistrate courts under section 48 of the Law of Succession Act. Jurisdiction is fundamental and cannot be conferred by consent or acquiescence of the parties. The proceedings before the trial court were therefore a nullity.
