The court found that while the applicant approached the court without unreasonable delay, they failed to demonstrate the substantial loss they would suffer if stay was not granted and did not propose any security as required by law. However, in the interests of justice and to preserve the subject matter of the appeal, the court exercised its discretion to grant a conditional stay of execution. The stay was allowed on the condition that the decretal sum is deposited in a joint interest-earning account in the names of both parties' advocates within 30 days, failing which execution would proceed.
