The respondent failed to follow the mandatory procedures set out in the Employment Act, including providing clear reasons for termination and an opportunity for the claimant to be heard. The evidence showed that the claimant was harassed by a senior staff member, and the respondent did not rebut these claims. As a result, the termination was both substantively and procedurally unfair, entitling the claimant to compensation and salary in lieu of notice.
