Miscellaneous Application / Ruling on Application to Set Aside Dismissal and Reinstate Suit

  1. 1 Whether the court should set aside the dismissal order dated 23 January 2018 and reinstate the claimant's suit.
  2. 2 Whether the claimant's application is properly anchored on the facts regarding representation by advocates.
  3. 3 Whether the mistake of the claimant's advocate should be visited upon the claimant.

Ratio Decidendi

The court found that the claimant's application to set aside the dismissal and reinstate the suit was predicated on the incorrect assumption that Ongicho-Ongicho & Co. Advocates were on record at the material time. In fact, Ogosso & Associates Advocates had already filed a Notice of Change of Advocates, and the claimant failed to disclose or clarify the status of her legal representation. Without a factual basis to support the claim of advocate error, the court held that there was no justification to exercise its discretion in favour of the claimant. The application was therefore dismissed.
