Criminal Miscellaneous Application / Ruling on Application for Revision of Sentence

  1. 1 Whether the High Court has jurisdiction to revise a sentence imposed by a court of equal and concurrent jurisdiction.
  2. 2 Whether the application for revision of sentence is competent under section 362 of the Criminal Procedure Code.

Ratio Decidendi

The court held that it lacked jurisdiction to revise a sentence imposed by a judge of the High Court, as section 362 of the Criminal Procedure Code only empowers the High Court to revise decisions from subordinate courts. Since the sentence in question was imposed by a court of equal and concurrent jurisdiction, the application for revision was incompetent. The appropriate remedy for the applicant is to pursue an appeal, for which a petition has already been filed. The court further noted that any issues regarding the timeliness of the appeal could be addressed by an application to appeal out of time.
