The registered owners, including Ambaisi, made no attempt to evict or assert ownership over the portion occupied by the plaintiff. The court held that the requirements for adverse possession under Section 7 of the Limitation of Actions Act were satisfied. The plaintiff was therefore entitled to be registered as owner of LR.No.Kisa/Mundeku/1466. However, the plaintiff had no claim to the other five parcels, as there was no evidence of adverse possession regarding those portions.
